Welcome to LetRents. These Terms of Service ("Terms") govern your access to and use of the LetRents platform, website, mobile applications, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not access or use our Services. We reserve the right to modify these Terms at any time, and your continued use of the Services constitutes acceptance of such modifications.

2. Eligibility and Account Registration

• Have the legal capacity to enter into binding contracts
• Not be prohibited from using our Services under applicable law

3. Service Description and Use

3.1 Services Provided

LetRents provides a comprehensive property management platform that includes:

• Property and unit management tools
• Tenant management and communication
• Rent collection and payment processing
• Maintenance request tracking
• Financial reporting and analytics
• Document storage and management
• Mobile applications for iOS and Android

3.2 Acceptable Use

You agree not to:

• Use the Services for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Services
• Use automated systems to access the Services without permission
• Impersonate any person or entity
• Collect or harvest information about other users

3.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

4. Subscription Plans and Payment

4.1 Subscription Plans

We offer various subscription plans with different features and pricing. Details of each plan are available on our pricing page. You may upgrade, downgrade, or cancel your subscription at any time through your account settings.

4.2 Payment Terms

• Billing Cycle: Subscriptions are billed monthly or annually based on your selected plan
• Payment Methods: We accept M-Pesa, Airtel Money, bank transfers, and credit/debit cards
• Automatic Renewal: Subscriptions automatically renew unless cancelled before the renewal date
• Price Changes: We will notify you 30 days in advance of any price changes
• Taxes: All prices are exclusive of applicable taxes, which will be added to your invoice

4.3 Free Trial

We offer a 30-day free trial for new users. No payment information is required to start your trial. After the trial period, you will be charged the subscription fee unless you cancel before the trial ends.

4.4 Refund Policy

We offer a 14-day money-back guarantee for new subscriptions. If you cancel within 14 days of your initial purchase, we will provide a full refund. Subsequent subscription renewals are non-refundable.

4.5 Late Payment

If payment fails, we will attempt to charge your payment method multiple times. If payment remains unsuccessful after 7 days, your account may be suspended. We reserve the right to charge late fees and interest on overdue amounts.

5. Intellectual Property Rights

5.1 Our Intellectual Property

The Services, including all content, features, functionality, software, trademarks, logos, and other intellectual property, are owned by LetRents and are protected by copyright, trademark, and other intellectual property laws.

5.2 License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes.

5.3 Your Content

You retain ownership of all content you upload to the Services. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, reproduce, and display your content solely for the purpose of providing the Services.

6. Data Protection and Privacy

We are committed to protecting your privacy and personal data in compliance with the Kenya Data Protection Act, 2019 and other applicable laws. Our Privacy Policy details how we collect, use, and protect your information.

As a data processor, we implement appropriate technical and organizational measures to ensure the security of personal data. You are responsible for ensuring that any personal data you process through our platform complies with applicable data protection laws.

7. Disclaimers and Limitations of Liability

7.1 Service "As Is"

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7.2 No Guarantee

We do not guarantee that:

• The Services will be uninterrupted, secure, or error-free
• The results obtained from using the Services will be accurate or reliable
• Any errors will be corrected
• The Services will meet your specific requirements

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LETRENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to indemnify, defend, and hold harmless LetRents, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any rights of another party
• Your content or data uploaded to the Services

9. Dispute Resolution

9.1 Informal Resolution

If you have any dispute with us, you agree to first contact us at legal@letrents.com and attempt to resolve the dispute informally.

9.2 Arbitration

If informal resolution fails, any dispute shall be resolved through binding arbitration in accordance with the Arbitration Act of Kenya. The arbitration shall be conducted in Nairobi, Kenya, in English.

9.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

10. Termination

10.1 Termination by You

You may terminate your account at any time by cancelling your subscription through your account settings or by contacting customer support.

10.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, if you:

• Breach these Terms
• Engage in fraudulent or illegal activity
• Fail to pay subscription fees
• Request account deletion

10.3 Effect of Termination

Upon termination:

• Your right to use the Services immediately ceases
• You remain liable for all charges incurred before termination
• We may delete your data after 30 days, subject to legal retention requirements
• You may export your data within 30 days of termination

11. General Provisions

11.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

11.2 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and LetRents regarding the Services.

11.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

11.4 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

11.5 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms at any time without notice.
